Relationship Property

Separating from your spouse or partner can be one of the most stressful situations you may encounter.  We can advise on your rights, your entitlements and your obligations under the Property (Relationships) Act 1976 so that you know where you stand.

We regularly advise on and prepare relationship property agreements (also known as contracting out agreements, separation agreements and pre-nuptial agreements).

If the dispute is one that proceeds to Court we are able to deal with that litigation.

The areas we advise on include:

  • The division of relationship property following separation
  • The division of relationship property after the death of one spouse or partner
  • Contracting out agreements (pre-nuptial agreements) (see also Asset Protection)
  • Relationship property agreements
  • Applications to the Family Court or High Court for the division of relationship property
